PARTICIPANT AGREEMENT

FC BAYERN SOCCER CAMPS CANADA

This Participant Agreement (“Agreement”) is entered into between Atarimae Soccer Inc., a corporation organized under the laws of the Province of Quebec, Canada (“Atarimae Soccer”, “we”, “our”, or “us”), and the parent, legal guardian, or participant identified in the registration form (“Participant”).

This Agreement applies to all programs, camps, clinics, activities, and services operated under FC Bayern Soccer Camps Canada anywhere in Canada.

By registering for any FC Bayern Soccer Camp Canada program, you acknowledge that you have read, understood, and agreed to the terms of this Agreement.


1. REGISTRATION AND PAYMENT

A completed registration form and payment of the applicable registration fee are required to reserve a place in the Camp.

All fees are stated in Canadian Dollars (CAD).

Except as expressly stated herein, participants are solely responsible for personal expenses related to participation in the Camp, including transportation, accommodation, meals, insurance, and incidental expenses.


2. CANCELLATION AND REFUND POLICY

Cancellation requests must be submitted in writing by email to: info@fcbayernsoccercampscanada.com.

Refunds shall apply as follows:

More than sixty (60) days prior to the Camp start date:

Refund of all amounts paid less a CAD $95 administrative fee.

Between sixty (60) and thirty (30) days prior to the Camp start date:

Fifty percent (50%) refund of the total amount paid.

Less than thirty (30) days prior to the Camp start date:

No refund shall be issued.

No refunds shall be issued for:

  • failure to attend the Camp,
  • voluntary withdrawal,
  • dismissal from the Camp,
  • or unused portions of the Camp.

3. CAMP MODIFICATIONS, SUBSTITUTIONS, AND FORCE MAJEURE

Atarimae Soccer reserves the right to modify schedules, locations, facilities, coaching staff, accommodations, or activities due to weather conditions, wildfire smoke conditions, safety concerns, government restrictions, labour disruptions, travel interruptions, public health events, facility availability, or other circumstances beyond its reasonable control.

Camp locations may be changed within a reasonable geographic radius when necessary.

Atarimae Soccer may substitute goods, services, facilities, or personnel with alternatives of comparable quality where reasonably necessary.

If a Camp is cancelled prior to commencement, Atarimae Soccer’s liability shall be limited to the refund of amounts actually paid for the cancelled Camp.

Atarimae Soccer shall not be liable for indirect, incidental, consequential, travel-related, accommodation-related, or other expenses or damages arising from such cancellation, interruption, delay, or modification.

If a Camp in progress must be interrupted or cancelled for reasons beyond Atarimae Soccer’s reasonable control, Atarimae Soccer may, in good faith and at its sole discretion, consider a partial refund based on services actually provided and costs incurred.


4. HEALTH DISCLOSURE AND FITNESS TO PARTICIPATE

The Participant and parent/legal guardian certify that the Participant is physically and mentally capable of participating in soccer-related activities.

The parent/legal guardian agrees to disclose any medical condition, disability, allergy, injury, dietary restriction, medication requirement, accessibility need, behavioural concern, pregnancy, communicable illness, or other relevant health information that may affect safe participation in Camp activities.

Atarimae Soccer does not guarantee that special accommodations or accessibility arrangements can always be provided.


5. ASSUMPTION OF RISK AND ATHLETIC ACTIVITIES RELEASE

The Participant and parent/legal guardian acknowledge that participation in soccer activities involves inherent risks, including but not limited to:

  • falls,
  • collisions,
  • physical contact,
  • weather conditions,
  • heat-related illness,
  • concussion,
  • communicable diseases,
  • unsafe playing surfaces,
  • equipment-related injuries,
  • transportation risks,
  • and other risks associated with athletic participation.

Participation is voluntary, and all such risks are knowingly and voluntarily assumed.

To the fullest extent permitted by applicable law, the Participant and parent/legal guardian waive and release Atarimae Soccer Inc., FC Bayern Munich, FC Bayern Soccer Camps, their respective affiliates, licensors, directors, officers, employees, coaches, contractors, sponsors, facility partners, agents, and representatives from claims arising from ordinary negligence related to participation in Camp activities.

Nothing in this Agreement excludes liability where prohibited by applicable law.


6. RESPONSIBILITY AND LIMITATION OF LIABILITY

Atarimae Soccer acts solely as organizer and coordinator of Camp services and may engage third-party suppliers, facilities, transportation providers, accommodation providers, and service providers.

Atarimae Soccer shall not be liable for:

  • acts or omissions of third parties,
  • transportation delays,
  • weather events,
  • government actions,
  • public health events,
  • facility closures,
  • or circumstances beyond its reasonable control.

Participants are expected to follow Camp rules and instructions from Camp staff at all times.

Atarimae Soccer reserves the right to remove any Participant whose conduct:

  • endangers themselves or others,
  • violates Camp policies,
  • interferes with Camp operations,
  • or is considered unsafe, inappropriate, abusive, violent, discriminatory, or disruptive.

No refund shall be owed in the event of dismissal.


7. MEDICAL AUTHORIZATION

The parent/legal guardian authorizes Atarimae Soccer to obtain emergency medical care for the Participant where reasonably necessary.

The parent/legal guardian accepts responsibility for all medical, transportation, pharmaceutical, and related expenses not covered by provincial healthcare, private insurance, or travel insurance.


8. TRANSPORTATION AUTHORIZATION

The parent/legal guardian authorizes the Participant to travel on Camp-related transportation, including buses, vans, or other transportation operated by approved providers.


9. MEDIA RELEASE AND IMAGE RIGHTS

The parent/legal guardian grants Atarimae Soccer Inc., FC Bayern Munich, FC Bayern Soccer Camps, and authorized promotional partners permission to photograph, film, record, and otherwise capture the Participant’s image, likeness, voice, and appearance during Camp activities.

Such materials may be used worldwide for:

  • promotional purposes,
  • websites,
  • social media,
  • advertising,
  • printed materials,
  • digital marketing,
  • public relations,
  • and other lawful commercial or promotional purposes related to Camp activities.

No compensation shall be owed for such use.

Consent may be withdrawn prospectively by written notice, subject to materials already produced or published.


10. PRIVACY

Personal information collected in connection with Camp operations shall be handled in accordance with applicable Canadian privacy laws, including:

  • the Personal Information Protection and Electronic Documents Act (PIPEDA),
  • applicable provincial privacy legislation,
  • and Quebec Law 25 where applicable.

11. COMMUNICABLE DISEASE ACKNOWLEDGEMENT

The Participant and parent/legal guardian acknowledge that participation in sports activities may expose participants to communicable illnesses, including but not limited to COVID-19 and its variants.

Participation is voluntary, and the Participant and parent/legal guardian knowingly assume risks associated with potential exposure to communicable illnesses.

To the fullest extent permitted by applicable law, the Participant and parent/legal guardian release and hold harmless Atarimae Soccer Inc. and related parties from claims arising from exposure to communicable illnesses, except where prohibited by applicable law.


12. WEAPONS, ALCOHOL, ILLEGAL SUBSTANCES, AND MEDICATIONS

Participants shall not possess or use:

  • firearms,
  • knives,
  • weapons,
  • illegal substances,
  • alcohol,
  • vaping products,
  • tobacco products,
  • unauthorized medications,
  • or dangerous items.

Violation of this policy may result in immediate dismissal from the Camp without refund.

Prescription medication must be disclosed to Camp staff and remain in its original labeled container.


13. GOVERNING LAW AND JURISDICTION

This Agreement shall be governed by the laws of the Province of Quebec and the applicable federal laws of Canada.

Any dispute arising from this Agreement shall be submitted to the competent courts located in the Province of Quebec, Canada.

To the extent permitted by applicable law, any claim against Atarimae Soccer must be commenced within one (1) year from the date of the incident giving rise to the claim.


14. ELECTRONIC SIGNATURES

Electronic signatures, online acceptances, and electronic acknowledgements of this Agreement shall be deemed legally binding and enforceable.


15. LANGUAGE

The parties acknowledge having requested that this Agreement and related documents be drafted in the English language.
